1. Agreement to Terms

By accessing or using the Aviera Pro Leads platform ("Service"), operated by Aviera Service LLC ("Company," "we," "us"), located in Tampa, Florida, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Aviera Pro Leads is a B2B lead marketplace that connects subcontractors with General Contractors, Home Builders, and Developers in Florida. The Service provides:

  • Marketplace access to purchase curated lead packs of construction companies actively seeking subcontractors
  • AI-scored leads (0–100) verified via Indeed job posting signals and website AI analysis
  • Contact information and business intelligence for each lead in a purchased pack
  • A dashboard to manage, track, and review your purchased leads

3. Access Fee, Packs, and Payments

3.1 Marketplace Access Fee. A recurring fee of $50/month is required to access the marketplace and purchase lead packs. This fee grants platform access only — no leads are included with the access fee itself.

3.2 Lead Packs. Leads are purchased separately as one-time pack purchases. Available packs are:

  • Pack 3: 3 leads — $149 (one-time)
  • Pack 5: 5 leads — $229 (one-time)
  • Pack 10: 10 leads — $399 (one-time)

Pack purchases are one-time payments and are not subscriptions. Purchasing a pack does not extend or modify your monthly access fee billing.

3.3 Billing. The $50/month access fee is billed monthly in advance via Stripe. By activating marketplace access, you authorize us to charge your payment method on a recurring basis until you cancel.

3.4 Payment Options. We accept major credit and debit cards via Stripe. Klarna buy-now-pay-later financing is available for pack purchases where offered at checkout.

3.5 Price Changes. We may modify pricing with 30 days written notice via email. Existing access fee subscriptions continue at their current rate until the end of the current billing cycle following the notice period.

3.6 Cancellation. You may cancel your marketplace access at any time through your dashboard settings. Cancellation takes effect at the end of your current billing period. You retain marketplace access until that date. Pack purchases already completed are not affected by cancellation.

4. Guarantees and Replacement Policy

Guarantee 1 — Data Accuracy (7-day replacement)

If any of the following apply to a lead in your pack, you may request a replacement lead at no charge:

  • The phone number provided does not exist or is permanently out of service
  • The company has closed or can no longer be found
  • The contact information provided is materially incorrect
  • A decision maker at the company confirmed (in writing or on a recorded call) that they do not and have never used subcontractors

You must report the issue within 7 days of pack purchase. This guarantee does NOT apply if the General Contractor simply did not respond — non-response is a normal part of sales outreach, not a data defect.

Guarantee 2 — Active Signal (48-hour replacement)

Every lead in our marketplace has a verified Indeed job posting or website AI signal confirming the General Contractor is actively seeking subcontractors at the time of verification. If we cannot demonstrate that a qualifying signal existed at or after the time the lead entered our inventory (i.e., the signal was already expired or closed before delivery), you are entitled to a replacement lead.

You must report the issue within 48 hours of pack purchase. This guarantee protects against stale inventory and does not apply to signals that expired after delivery.

Guarantee 3 — First Month Risk-Free ($50 refund)

First-time subscribers who activate marketplace access and choose not to purchase any lead pack within the first 14 days may request a full refund of their $50 access fee. No questions asked.

  • This guarantee is available one time only, to first-time subscribers exclusively
  • If any pack has been purchased, this guarantee no longer applies (you found value in the marketplace)
  • Refund request must be submitted within 14 days of initial marketplace activation

Guarantee 4 — Pack Completeness

You will receive exactly the number of leads specified in your purchased pack. In the rare edge case where available inventory changes between your purchase and delivery (due to simultaneous purchases by other subscribers), any shortfall will be credited as store credit toward your next pack purchase, calculated pro-rated per lead value.

Example: You purchase Pack 5 ($229) and receive 4 leads due to a stock conflict. The remaining 1 lead = $229 ÷ 5 = $45.80 store credit applied to your account.

4.1 General Replacement Conditions. Replacement leads are subject to availability. Replacements are issued as equivalent leads within the same geographic area and industry when possible. Maximum one (1) replacement per individual lead. Guarantees are non-transferable and apply only to the original purchasing subscriber.

4.2 Pack Purchase Refunds. Outside of the guarantees described above, pack purchases are non-refundable once leads have been delivered and their information revealed.

4.3 Access Fee Refunds. Monthly access fees are non-refundable for the current billing period, except as provided under Guarantee 3 for first-time subscribers.

4.4 Fraudulent Reports. Filing false or fraudulent replacement requests will result in immediate and permanent account termination without refund.

5. Lead Information Disclaimer

5.1 No Guarantee of Results. Leads provided through the Service are business opportunities, NOT guaranteed contracts. We do not guarantee that any lead will result in a business relationship, contract, or payment.

5.2 AI-Based Scoring. Each lead carries an AI-generated score from 0 to 100, calculated based on signals including website content, job postings, company activity, and other publicly available data. Scores represent estimates of likelihood to need subcontractors and are not guarantees of intent, budget, or availability.

5.3 Verification Method. Leads are verified using two primary signals: (a) active Indeed job postings indicating the General Contractor is hiring or seeking trade partners, and (b) website AI analysis that reviews company pages for language and patterns consistent with active subcontractor use. Both signals are assessed at the time the lead enters our inventory.

5.4 Data Accuracy. While we strive for accuracy, we cannot guarantee that all contact information, business details, or hiring signals remain current between verification and the time you contact the lead. Business conditions change. Our accuracy guarantee (Section 4, Guarantee 1) covers material inaccuracies at the time of delivery, not subsequent changes.

5.5 Information Guarantee, Not Outcome Guarantee. We guarantee the accuracy of information at the time of verification — not the result of your outreach. A lead represents a verified business opportunity, not a guaranteed contract or response.

6. Acceptable Use

You agree NOT to:

  • Resell, redistribute, or share lead information with third parties
  • Use leads for spam, harassment, or any unlawful purpose
  • Share your account credentials with others
  • Scrape, copy, or systematically download data from the platform
  • Misrepresent yourself or your business when contacting leads
  • Use the Service to collect data for competing lead generation services

Violation of these terms may result in immediate account suspension or termination without refund.

7. Account Termination

We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or harms the integrity of the Service. You may delete your account at any time through your dashboard settings.

8. Intellectual Property

All content, data, scoring algorithms, AI models, and platform features are the property of Aviera Service LLC. You receive a limited, non-exclusive license to use lead information from purchased packs for your own business development purposes only.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIERASERVICE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Aviera Service LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your interactions with leads provided through the Service.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Hillsborough County, Florida.

12. Changes to Terms

We may update these Terms at any time. We will notify you via email of material changes at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
